Terms of Service

This public offer (the “Offer”) sets out the terms of subscription access to the Profiforce service and of services provided on request on the Profiforce website (the “Site”). Seller: Sole proprietor (IE) Gleb Bychkov, TIN (ՀՎՀՀ) 20318469, state registration number 286.1589295, address: Republic of Armenia, Yerevan, Arabkir district, Khapantsyan St. 51/4, apt. 6, 0014, e-mail hello@profiforce.com.

1. General

The Offer is addressed to an unlimited audience and constitutes the Seller’s official proposal to enter into a contract on the terms below. Starting to use the Service (including the free trial), paying for a subscription or paying an invoice for a request constitutes full and unconditional acceptance of the Offer; the person who accepts it is referred to as the “Client”. In this Offer: the “Service” is the Profiforce service — a catalog of ready-made AI automations that run on the Seller’s servers and that the Client sets up in their account with the setup wizard; an “Automation” is a ready-made workflow from the Service catalog; a “Subscription” is paid access to the Service for the chosen term on the chosen plan; the “Account” is the Client’s personal account on the Site and in Telegram.

2. Subject

The Seller provides the Client with: (a) subscription access to the Service — the right to add any Automations from the catalog to the Account, set them up and use them while the subscription is active; (b) services on the Client’s request — customizing a ready-made Automation for the Client’s needs and developing a new Automation (section 6). Automations run only on the Seller’s servers: workflow files and self-installation guides are not provided to the Client. Each Automation is described on its page on the Site; plans are listed on the “Pricing” page.

3. Plans and subscription

3.1. A plan sets how many Automations can run at the same time and the monthly AI budget. Any number of Automations can be added to the Account and set up; the Client can switch an Automation on or off in the Account at any time within the plan. Plan names, limits, AI budgets, available terms and prices are listed on the “Pricing” page and form part of this Offer. Some Automations do not take up a slot in the plan — this is stated on their page or in the Account.

3.2. A subscription is paid for a term of 1, 3, 6 or 12 months; the available terms depend on the plan. The subscription starts once the payment is confirmed. If a subscription on the same plan is already active, the paid term is added to the remaining one.

3.3. There is no auto-renewal and no automatic charges: the Client renews the subscription by paying for a new term. Before the subscription ends, the Seller sends the Client reminders.

3.4. Changing plans. When the Client switches to another plan, the remaining days of the current subscription are converted into days of the new plan in proportion to the monthly prices of both plans, and the paid term is added to them; money for unused days is not lost. If the new plan allows fewer Automations to run at the same time than are switched on, the Client chooses which ones to keep; if the Client makes no choice, the most recently switched-on Automations keep running and the rest are paused with their settings kept.

3.5. AI. A plan includes a monthly AI budget for requests from the Client’s Automations to AI models connected by the Seller. The budget renews every month; unused budget does not roll over. When the budget runs out, Automations may work in a limited mode until it renews. The Client may connect their own AI service key (for example, OpenRouter): requests then run on the Client’s key with no plan limit and are paid by the Client directly to that service at its rates. The Client obtains accounts and keys for other third-party services (Telegram, Google, Meta, etc.) on their own and uses them under those services’ terms.

4. Free trial, beta and bonus days

4.1. Free trial. On first registration the Client gets a free trial — 7 days of the “Business” plan at no charge, no card required. The AI budget during the trial is smaller than on a paid plan. The trial is given once per person; registering with another email address or Telegram account to get a new trial is not allowed, and in that case the Seller may refuse or end the trial. If the Client pays for a subscription during the trial, the remaining trial days are kept and added to the paid term.

4.2. Beta. A new Automation has the “Beta” status for 30 days after release and during that time does not take up a slot in the plan. A Beta Automation may contain errors and may change; the Seller fixes reported errors as soon as practicable.

4.3. Bonus days. The Client may report an error with the “Report a problem” button or through support. For an error confirmed by the Seller, the Seller may add extra subscription days on the Client’s current plan. Whether an error is confirmed, whether days are added and how many is at the Seller’s discretion. Bonus and trial days cannot be exchanged for money and are not counted in refunds.

5. End of subscription and data retention

If the subscription or the trial ends and is not renewed, the Client’s Automations are paused: bots do not reply and workflows do not run. Automation settings and data are kept for 90 days from the end of the subscription and then deleted permanently; the Seller reminds the Client 30 and 7 days before deletion. If the Client renews before deletion, the Automations can be switched back on with their previous settings. The Account and payment history are kept. Retention of third parties’ data processed by Automations is governed by clause 13.9.

6. Services on request

The Client can submit a request on the Site to customize a ready-made Automation or to develop a new one. The Seller states the price, scope and timing after reviewing the task; work starts once the invoice issued in the Account is paid. The scope, timing, delivery procedure and warranty for a specific request are set out in the invoice and the request chat and form part of the contract. All communication on a request is in writing — in the Account and by email. The result runs in the Service under the subscription, unless the invoice states otherwise. The warranty covers only the work performed by the Seller and does not cover changes made by the Client or third parties after delivery, or changes of third-party services.

7. Prices and payment

Prices are listed in Armenian drams (AMD), Russian rubles (RUB) or US dollars (USD). The Seller may change prices; changes do not affect subscription terms and invoices already paid. Payment is made using the methods available on the Site; the payment obligation is fulfilled once the payment provider confirms the payment. Card payments are settled by the acquiring bank Ardshinbank OJSC through the Armenian Card processing centre. Paying by card does not increase the price — no card acceptance fee is charged to the Client. The bank may limit the amount and number of card transactions; if card payment is unavailable, the Client can use another payment method available on the Site. Once the payment is confirmed — usually within a few minutes — the plan and subscription term appear in the Account, and the Client receives a confirmation and an electronic receipt.

7.1. Payment with Telegram Stars. If the Client chooses to pay with Telegram Stars, the invoice opens inside the Telegram app, and the Stars themselves are purchased by the Client from Telegram or an app store at their own rates. The number of Stars is calculated so that the Seller receives the price shown on the Site; the difference between what the Client pays for Stars and what reaches the Seller is a fee of Telegram and the app stores, is not received by the Seller and is not set by the Seller. The Client sees this surcharge on the checkout page before paying. A refund for such a transaction is made only in full and only in Stars to the same Telegram account.

8. Rights to the Service

The Service, the Automations, their workflows, texts and guides belong to the Seller. For the duration of the subscription the Client receives a simple (non-exclusive) license to use the Service in their business and for personal purposes. Reselling or sharing access with third parties, copying Automations and attempts to extract their workflows are prohibited. Data and materials the Client uploads to the Service remain the Client’s. Rights to the result of a service on request are set out in the invoice; if the invoice says nothing about them, this section applies.

9. Refunds

Refunds are governed by the Refund Policy published on the Site, which forms an integral part of this Offer.

10. Liability

The Service is provided “as is”. The Seller does not guarantee specific business outcomes and is not liable for interruptions or inability to use the Service caused by changes, failures or pricing of third-party services (Telegram, Google, Meta, AI providers, etc.), by the Client’s actions or by circumstances beyond the Seller’s control. Beta Automations are provided for testing and may contain errors. The Seller’s aggregate liability is limited to the Client’s subscription payments for the last 3 months and, for services on request, to the amount of the relevant invoice.

11. Support

The Help center is open to everyone. After signing in to the Site (by email or with Telegram, free of charge), the AI consultant in Telegram is available — it replies instantly, 24/7; questions about payment, subscriptions and refunds are handled by a specialist as part of personal support. Personal support from a specialist (tickets in the Account, a dedicated Telegram group and email) is provided to Clients with an active subscription, including during the free trial. “Personal support” means that a human specialist, not AI, answers the requests; no dedicated specialist is assigned to each Client. The specialist is available daily, 10:00–22:00 Yerevan time, seven days a week. For payment and refund questions you can always write to hello@profiforce.com.

12. Personal data

Personal data is processed in accordance with the Privacy Policy published on the Site. Processing of third parties’ data by the Client’s Automations in the Service is governed by section 13.

13. Processing of personal data on the Client’s behalf

13.1. This section is the Client’s instruction to the Seller to process personal data (Article 14 of the RA Law “On Protection of Personal Data”; for Clients subject to other laws, a data processing agreement within the meaning of those laws). It applies when the Client’s automation in the Service processes data of third parties: candidates, employees, tenants, guests, chat members, etc. (the “Data Subjects”). Accepting the Offer and clicking “I confirm” in the setup wizard constitute the written form of the instruction.

13.2. Roles. The Client is the controller (operator) of the Data Subjects’ personal data: it determines the purposes and means of processing and is responsible to the Data Subjects and public authorities. The Seller processes the data only on the Client’s instructions, to the extent needed to run the chosen automation, and does not use it for its own purposes, including model training, analytics or advertising.

13.3. Purpose, scope and operations. The purpose, data categories, Data Subjects and operations for each automation are set out in its guide and setup wizard, which form part of the instruction. For the “AI Candidate Screening in Telegram” automation: purpose — reviewing applications to the Client’s vacancies; data — name, Telegram data, phone, questionnaire answers, voice messages and their transcripts, CV file and text, stages, decisions and notes; Data Subjects — candidates; operations — collection via the bot, recording, storage, display to the Client’s team, AI-assisted scoring and transcription, deletion.

13.4. Recipients (sub-processors). The Client agrees to the use of: the hosting provider Hostinger International Ltd. (server in the United Kingdom); OpenRouter, Inc. (USA) and the model providers connected through it (Google LLC and others), with data retention and training prohibited where the provider supports it; Telegram, to deliver messages. The Seller notifies the Client of changes to this list 14 days in advance; if the Client objects and the parties do not agree, the Client may stop using the automation.

13.5. Cross-border transfer. The Client acknowledges that the data is stored and processed outside the Republic of Armenia, including in the United Kingdom and the USA. The Client itself ensures a legal basis for such transfer: the Data Subject’s consent and, where the law requires, a permit from or notification to the competent authority.

13.6. Security measures. The Seller stores the data on a protected server, transmits it only over encrypted channels, restricts access (Seller staff access the Client’s data only for support at the Client’s request or to fix a failure, with a log entry), keeps it confidential during and after the term of the Offer, and maintains a log of the automation’s decisions.

13.7. Data Subjects’ rights. The Seller provides the Client with tools to fulfil Data Subjects’ rights: viewing, correcting and deleting data, and the bot commands /mydata and /delete where available. At the Client’s request, the Seller assists within 2 business days with a request these tools cannot handle.

13.8. Incidents. Upon becoming aware of unauthorised access to or a leak of the Client’s data, the Seller notifies the Client without undue delay and no later than 24 hours, by email and in Telegram: what happened, which data is affected, and what measures were taken. Public notices and reports to authorities that the law requires from the controller are made by the Client; the Seller provides the necessary information.

13.9. Retention and deletion. Data is kept for the periods the Client chose in the settings and deleted automatically; after the subscription ends — within 90 days. Data disappears from backups as they are rotated; the Seller will not restore data deleted on request from backups, except when recovering from a failure. Upon the Client’s written request, the Seller deletes data earlier and confirms deletion.

13.10. Client’s obligations. The Client warrants that: (a) it has a lawful basis for processing and shows Data Subjects the consent and notices; if the Client supplements the standard text, the Client is responsible for the supplement; (b) questionnaire questions, criteria and job texts do not ask for age, sex, nationality, religion, health, marital status, appearance or other traits unrelated to the job and are not discriminatory; (c) it notifies the competent authority itself where the law requires (for example, of processing biometric or special-category data); (d) decisions about Data Subjects are made by a human, and the AI score serves only as a hint; (e) it does not recruit persons under 16 through the automation without a legal representative’s consent.

13.11. Restrictions. Automations processing third parties’ personal data are not intended for and may not be used: (a) by Clients subject to Russian Federal Law No. 152-FZ “On Personal Data” (the requirement to store data in Russia is not met); (b) to screen job candidates in the European Union, the European Economic Area or the USA. A Client using an automation in breach of this clause is solely responsible and reimburses the Seller for any resulting costs.

13.12. AI. Scores, texts and transcripts produced by AI may be inaccurate. The Seller is not liable for decisions the Client makes based on them or for content the Client publishes.

13.13. Liability. The Seller’s liability under this section is limited to the amount the Client paid for the subscription in the 3 months preceding the event, except in cases of the Seller’s intent or gross negligence. The Client indemnifies the Seller for losses and fines arising from the Client’s breach of clauses 13.10–13.11.

13.14. Priority. In case of conflict, this section prevails over the other terms of the Offer with respect to personal data.

14. Changes

The Seller may amend the Offer; the new version takes effect upon publication on the Site and does not affect subscription terms and invoices already paid. Orders paid before this version was published are performed on the terms in force at the time of payment.

15. Governing law

The relations of the parties are governed by the laws of the Republic of Armenia; disputes are resolved through negotiations or, failing that, by a competent court of the Republic of Armenia.
